The Department of Home Affairs had initiated the cancellation based on substantial evidence obtained through cross-referencing information, which revealed numerous discrepancies in the application materials. The case was further complicated by the Department&#8217;s ongoing investigation into the unregistered migration agent involved in the original application.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-577da05 e-flex e-con-boxed e-con e-parent\" data-id=\"577da05\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-9cace35 elementor-widget elementor-widget-heading\" data-id=\"9cace35\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">Taking Over the Case:<\/h5>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-111177d elementor-widget elementor-widget-text-editor\" data-id=\"111177d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p class=\"ds-markdown-paragraph\" data-spm-anchor-id=\"0.0.0.i270.aa733897nwOu3K\">The situation appeared particularly challenging as the Department possessed compelling evidence that could not be fully disclosed during proceedings due to legal restrictions. We assisted the appellants in preparing extensive documentation prior to the hearing at the Administrative Appeals Tribunal (AAT, now known as the Administrative Review Tribunal or ART).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-221d303 e-con-full e-flex e-con e-child\" data-id=\"221d303\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-087e30c elementor-widget elementor-widget-heading\" data-id=\"087e30c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">The Day of the Hearing:<\/h5>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ebc53b8 elementor-widget elementor-widget-text-editor\" data-id=\"ebc53b8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p class=\"ds-markdown-paragraph\" data-spm-anchor-id=\"0.0.0.i269.aa733897nwOu3K\">At the commencement of the AAT (now ART) hearing, the Member expressed strong skepticism toward the appellants&#8217; claims and showed firm support for the Department&#8217;s decision to cancel the visas. Facing this initially hostile reception, we made strategic oral submissions as the appellants&#8217; representatives. Despite the Member&#8217;s aggressive stance, we successfully secured additional time &#8211; 21 days &#8211; to submit further evidence and materials to address the Tribunal&#8217;s concerns.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-b9e5bdf e-flex e-con-boxed e-con e-parent\" data-id=\"b9e5bdf\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-4a0caa5 elementor-widget elementor-widget-heading\" data-id=\"4a0caa5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">Successful Outcome:<\/h5>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-528a194 elementor-widget elementor-widget-text-editor\" data-id=\"528a194\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p class=\"ds-markdown-paragraph\">During the extended period, we conducted multiple case conferences, thoroughly re-examined all documentation, and maintained close communication with the appellants. With their full cooperation, we prepared comprehensive supplementary submissions. The additional materials, submitted on the final day of the extended deadline, proved decisive. The Tribunal Member&#8217;s perspective shifted substantially upon review of our supplementary evidence, leading to a full reversal of the Department&#8217;s decision the following day.
